Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Ditch service ("the Service") operated by Elemental Media LLC ("the Company", "We", "Us", or "Our").

By using the Service, You agree to be bound by these Terms. If You do not agree, please do not use the Service.

1. The Service

Ditch is an AI assistant that You interact with entirely through iMessage. Rather than installing an app or creating an account, You simply text a phone number and receive AI-powered responses directly in Your iMessage conversation. The assistant feels like a normal contact in Your messages.

To get started, You either tap a "Text on iMessage" button on mobile or scan a QR code on desktop. Both methods open iMessage with the assistant's number prefilled so You can begin messaging immediately.

Your messages are processed using one or more AI models from providers such as OpenAI, Anthropic, and Google. The system selects models dynamically depending on the task (e.g., chat, reasoning, image generation). We do not develop or control the underlying AI models.

2. Acceptance of Terms

By sending a message to the Service, You agree to these Terms. These Terms apply to all users, whether accessing the Service via iMessage, the website, or any other method We provide.

3. Your Account

Your phone number and iMessage identity serve as Your account. No separate account creation is required to begin using the Service. You are responsible for all activity associated with Your number. Don't share access or use the Service for anything illegal. If You suspect unauthorized use, contact Us immediately. We may suspend accounts showing suspicious activity without prior notice.

4. AI Capabilities

Through iMessage, You can ask the assistant to perform tasks such as:

  • Answering questions
  • Writing messages or content
  • Generating images
  • Summarizing information
  • Helping with productivity tasks

All interactions occur through simple text messages. No new interface to learn - You just text.

5. Integrations

You may optionally connect external services through the Ditch website. These integrations may include services like Gmail, Google Calendar, Microsoft services, and Notion.

After linking an account, the assistant can access relevant data to perform tasks You request through iMessage, such as checking a calendar, creating events, or retrieving information.

When You connect third-party apps, You grant Ditch permission to access those services on Your behalf. You can revoke access at any time. We are not responsible for third-party service outages, data handling, or changes to their APIs. Integration availability may change without notice.

6. Web Portal

While messaging happens through iMessage, the website at ditch.app serves as a control panel where You can connect integrations, manage account settings, review subscription status, and configure features. This keeps the messaging experience simple while still providing advanced configuration options.

7. Acceptable Use

Don't use Ditch to generate harmful, illegal, or abusive content. Don't attempt to reverse-engineer, overload, or exploit the Service. Don't use automated systems to send messages at scale. Don't impersonate others or misrepresent Your identity. We reserve the right to suspend or terminate accounts that violate these Terms without refund.

8. Payments and Billing

You can initially interact with the assistant freely or with a limited usage allowance. Once certain usage thresholds are reached, the Service may require a subscription or payment to continue accessing advanced features or higher usage limits.

Payments are processed through Stripe. Paid plans are billed monthly. You can cancel anytime - Your access continues through the end of the billing period. Refunds are not provided for partial months. We reserve the right to change pricing with 30 days notice.

9. Intellectual Property

You own the content You create through the Service. We don't claim ownership of Your messages, files, or data. The Ditch name, logo, and branding are Our property. You may not use Our branding without written permission.

10. AI Output Disclaimer

AI responses may be inaccurate, incomplete, or misleading. The Service should not be relied upon for medical, legal, financial, or other professional advice. Always verify important information independently. We are not liable for any consequences resulting from reliance on AI-generated content.

11. Limitation of Liability

Ditch is provided "as is" without warranties of any kind, whether express or implied. To the maximum extent permitted by law, We disclaim all liability for damages arising from Your use of the Service, including but not limited to direct, indirect, incidental, or consequential damages.

12. Termination

You can stop using the Service at any time. We may terminate or suspend Your access at Our discretion, particularly if You violate these Terms. Upon termination, Your right to use the Service ceases immediately. Sections regarding liability, intellectual property, and disputes survive termination.

13. Disputes

Any disputes will be resolved through binding arbitration rather than in court. You agree to resolve disputes individually and waive any right to participate in class actions. These Terms are governed by the laws of the State of Wyoming, United States.

14. Changes to Terms

We may update these Terms at any time. Continued use after changes means You accept the new Terms. We will notify You of significant changes via iMessage or through the website. The latest version will always be available on this page.
